What If I Still Haven’t Gotten The First Or Second Stimulus Check

You’ll need to file your 2020 tax return to claim any stimulus money you’re owed from the first two rounds.

There will be a separate worksheet on your tax return with instructions for calculating any outstanding amount owed to you, called the Recovery Rebate Credit. If you file your taxes online, the provider will prompt you to enter the information and do the calculations for you.

If you do qualify for additional stimulus money, you won’t get it right away. It will first be applied to your outstanding tax bill. If your bill is reduced to $0, the rest of the money will be added to your refund. The IRS delivers most refunds within three weeks.

Larger Base Amount For Third Stimulus Checks

The base amount of first-round stimulus checks under the CARES Act was $1,200 . That amount was cut down to $600 for second-round payments under the COVID-Related Tax Relief Act. But the base amount for third-round stimulus payments will be higher than either the first- or second-round payments.

The base amount for your third stimulus check will be $1,400. President Biden and Senate Democrats settled on that amount because many Americans thought the $600 second-round checks were insufficient and that they should have been for $2,000. However, not every lawmaker was willing to go that far and support an additional round of $2,000 stimulus checks. So, instead, the idea of authorizing a combined total equaling $2,000 was born . In fact, the House even passed a bill in December the CASH Act that would have done just that, although it was blocked by Republicans in the Senate and never became law.

Are Recovery Rebate Credit Garnishments Unfair

Because of the tax-law change made in December, the rug is being pulled out from under eligible individuals with outstanding debts, said Erin Collins, National Taxpayer Advocate, in a January 28 blog post. Since the spring, the IRS reassured these taxpayers that if they claim the when they file their 2020 returns, they will get the full amount of stimulus money they are eligible for and be made whole. Now that reassurance turns out to be inaccurate based upon the law change.

Heres the situation, according to Collins:

  • People with certain outstanding debts who received the full amount of their stimulus checks didnt have their payments subject to garnishment , but
  • People with similar outstanding debts who didnt receive the full amount of their stimulus checks will receive a reduced Recovery Rebate credit or nothing at all when they claim it on their 2020 tax return.

This disparate result undermines public confidence in the fairness of the tax system, said Collins. Financially struggling taxpayers who were entitled to receive the full amount of the last year but did not have effectively been harmed once. It is unfair to harm some of these taxpayers a second time by seizing some, or all, of their stimulus payments.

Your Third Stimulus Payment Can’t Be Seized To Pay Child Support

Garnishing stimulus checks: Can my stimulus check be garnished?

Under the CARES Act from March 2020, your first stimulus check could be seized by state and federal agencies to cover past-due child support. That rule changed for the second stimulus check, which couldn’t be taken if you owe money for child support. And like the second check, your third check cannot be taken to pay overdue child support.

According to the text of the bill, payments will not be subject to reduction or offset for past-due federal or state debts, or by other assessed federal taxes that would otherwise be subject to collection. However, if you end up having any money missing from your third check and have to claim it on your tax return next year, that money could be subject to garnishment . The best thing to do is to file your 2020 tax return as soon as possible, so the IRS has your most recent information on file.

People with children will benefit from other aspects of the bill outside of the third stimulus check. For example, updates to the Child Tax Credit increase the existing amount to as much as $3,600 per child. There are also some other tax breaks to take advantage of, including for child care.

Can My Recovery Rebate Credit Be Garnished

The first and second rounds of stimulus checks authorized in March 2020 and December 2020 were protected from federal and state debt offsets, and even private debt collectors in some cases.

Unfortunately, the same protections don’t apply when these payments are claimed as the Recovery Rebate Credit on your 2020 return. Remember, you can only claim the credit if you’re missing a stimulus check you qualify for, or you received too little based on your 2020 income and tax situation.

Your stimulus tax credit can be used to offset state or federal debts, like past-due child support . Your credit cannot be used to offset federal taxes you owe for prior years, according to guidance .

Biden Stimulus Plan Would Boost Incomes For Nations

The Tennessee Department of Human Services, which handles child support, said the decision to intercept the first round of stimulus payments for child support was made at the federal level.

The second round of stimulus was not intercepted for child support arrears, and as for any third payment, right now they are not sure what requirements it will have.

But on the other side of child support are often another parent and children also dealing with finances. Attorney Williams Jones represents many of those families.

The stimulus I know was supposed to help individuals during this time, but you have to think about that mother that didnt have help throughout the years, Jones said.

While Jones is not involved in Fraziers case, he has seen how families suffer when child support isnt paid.It doesnt make a difference that the child is 19 now. That money is owed to her in the past and she is entitled to it. The government is just giving it to her because he finally has some money, Jones said. I am actually kind of disappointed that they carved it out that we cant garnish from the second and possibly the third check. I think it was good for single moms and single dads who are trying to raise kids alone.

Frazier is hoping someone in Washington will make some exceptions in special cases where intercepted funds are not going directly to parents and children.

Incarcerated People Are Eligibly For All 3 Stimulus Checks

Some $1,400 stimulus payments could be garnished for unpaid debts

Though there was a lot of confusion about this at first, people who are in prison and jail are eligible to qualify for the first stimulus check of up to $1,200 per adult, as well as the second check of up to $600 and the third check of up to $1,400. A ruling this fall from a federal judge in California required the IRS to contact those incarcerated who can file a claim for a stimulus check. As with others who are missing any of the payments, youll need to fill out 2020 Form 1040 or 1040-SR to claim either the first or second check.

Special Strategy For At

A special strategy for those at risk of garnishment is available for recipients of Social Security, SSI, Veterans, or certain other federal benefits. A U.S. Treasury rule exempts from garnishment an amount in a bank account or Direct Express card equal to two months of federal benefit payments for that individual. See 31 C.F.R. § 212 NCLCs Collection Actions § 14.5.4.

The protected amount in a consumer’s account need not be traced to the federal benefitsthat dollar amount is protected no matter its source. If two months of federal benefits for a Social Security recipient is $2000, the account will be fully protected from garnishment if there is only $800 in the bank account before the stimulus payment is deposited. Once the $1200 is deposited, the total amount will still be less than $2000. Before the next Social Security or other benefit payment is deposited, however, the recipient will need to withdraw additional amounts to keep the new balance under $2000. Fortunately, benefit payments come on a predictable date each month, such as the second Wednesday of the month.

This strategy comes with a cost, as described above, since it may be more convenient and safer to keep all funds in the bank account than to rush to withdraw cash or make payments from the account.

Q I Have Old Credit Card Debt Plus Old Unpaid Medical Bills Will The Creditors Seize My Stimulus Check

A. Maybe, IF the creditors already have a court order placing a claim or freeze on your bank account.

Yes, debt collectors can, in fact – if they have a court order – try to tap into the money through the bank account, said Professor Usha Rackliffe, with the Goizueta Business School at Emory University in Atlanta.

A stimulus check can be garnished by any private debt collector seeking payment from a debtor in Georgia.

When Congress passed the latest COVID relief stimulus plan, the legislation made a distinction between private debt – money owed to credit card companies, hospitals, school tuition lenders, for example – and government debt, such as back taxes and delinquent child support payments.

Professor Rackliffe said the previous stimulus checks, issued this past December, were protected from any and all garnishment by both private and government creditors.

But Rackliffe said that under the new federal law governing the current stimulus payments, private debt collectors can garnish a debtors stimulus check, but government debt collectors cannot.

However, these rules have not necessarily extended to the situation of filing for missing stimulus check money on your 2020 tax return. For certain outstanding debts — including past-due child support and unpaid student loans — the IRS can withhold some or all of your unpaid stimulus payment issued as a Recovery Rebate Credit when you file your taxes. Understanding Garnishment Of Stimulus Payments

Lawmakers approved this round of stimulus funds without the provision necessary to protect them from creditors. This means that private debt collectors can pursue garnishment to pay various debts, from medical bills and student loans to credit cards and taxes.

That said, borrowers should know that wage garnishment can only occur in specific circumstances. And garnishment practices and limits vary by state. In Pennsylvania, for instance, there are strict limits on the types of debt that can lead to garnishment and how much of a persons wages can be garnished.
