Some bankruptcy courts argue that consumers can be denied a discharge if they are not current on their mortgage, even if they are otherwise up-to-date on other payments under their bankruptcy plan, said John Rao, an attorney with the National Consumer Law Center.

The bill provides other protections: People who have filed for bankruptcy or who have already received a discharge cannot be denied a mortgage forbearance or eviction protection created under the CARES Act.

Filers can also have their utility service maintained or restored without paying a deposit, Mr. Rao said.

All of these provisions expire a year after the bill is enacted.

What About Rental Evictions

The agreement extends a moratorium on renter evictions through Jan. 31.

The Trump administration, through an order from the Centers for Disease Control and Prevention, had already extended a previous eviction ban through the end of the year. The agency said the moratorium was needed to prevent renters from ending up in shelters or other crowded living conditions, which would put them at higher risk of contracting the coronavirus.

The new agreement simply extends that order. To be eligible, renters must have experienced a substantial loss of household income, a layoff or extraordinary out-of-pocket medical expenses, among several other conditions and they cant expect to earn more than $99,000 in 2020 .

Electronic Delivery Of Payments

The Social Security Administration no longer mails paper checks, although the U.S. Department of the Treasury does occasionally make some isolated exceptions to this rule. Otherwise, there are two ways you can receive your benefits:

High earners may also see a smaller stimulus check, or none at all. As with the CARES Act, Congress imposed income limits for the second stimulus check. However, the math looks a little different because the second checks are smaller .

Here’s what the current limits look like:

  • Single filers with incomes under $75,000 will get the full stimulus payment. Under the CARES Act, those with incomes under $99,000 received a partial payment and people with incomes above that limit did not receive a check. Since Congress has kept the phase-out formula the same but the second checks are for a smaller amount, those with incomes over $87,000 may lose their stimulus payments entirely this time.
  • Heads of households with incomes under $112,500 will get the full stimulus payment. Under the CARES Act, payments phased out until an income limit of $146,500 after which no money was provided. Under the new bill, with smaller check amounts but the same phase-out formula, no money would be provided to those with incomes above $129,500.

It should be noted that the CARES Act reduced payments at a rate of $5 per $100 in excess income over the $75,000, $112,500, and $150,000 thresholds. Congress did not change this formula in the current legislative text, but it is possible this was an oversight. Regardless of what the phase-out rules are, higher earners who lose eligibility for their own stimulus payments may still get some money for eligible dependents, depending on how much they earn.

Will Anything Else Change

There is a provision to help unemployed people who have a mix of income from both self-employment and wages paid by other employers. These people are often stuck with a lower state-issued benefit based on their wages.

The agreement will try to ameliorate that problem by providing an additional federal benefit of $100 weekly to individuals who have earned at least $5,000 a year in self-employment income, but are disqualified from receiving a more generous Pandemic Unemployment Assistance benefit because theyre eligible for state benefits.

Lets say a person earned most of their income through larger freelance jobs from movies, but took lower-paying jobs at restaurants in between. Such a worker would qualify for lower, state-level benefits based on the restaurant work.

This $100 weekly payment will be added to the $300 weekly federal benefit, and will also end on March 14. The benefit will begin only after your state reaches an agreement with the Labor Department.

Are Stimulus Checks Enough To Help Families From Poverty
