Can My Recovery Rebate Credit Be Garnished
The first and second rounds of stimulus checks authorized in March 2020 and December 2020 were protected from federal and state debt offsets, and even private debt collectors in some cases.
Unfortunately, the same protections dont apply when these payments are claimed as the Recovery Rebate Credit on your 2020 return. Remember, you can only claim the credit if youre missing a stimulus check you qualify for, or you received too little based on your 2020 income and tax situation.
Your stimulus tax credit can be used to offset state or federal debts, like past-due child support . Your credit cannot be used to offset federal taxes you owe for prior years, according to guidance .

If you did not get all or some portion of your Economic Impact Payments you can file a 2020 tax return and claim these amounts on line 30 of the form. The IRS is referring to this as the recovery rebate and will allow you to claim any of the EIPs that you did not get in advance. You may get a denial letter from the IRS, but that is the opportunity to reply and explain your situation to the IRS.

Third Stimulus Checks: Could We Get $1400 Payments In February
WASHINGTON After winning the presidential election, Joe Biden vowed to get Americans a new round of economic relief through $1,400 direct payments. Nearly a month later, we havent seen much movement on his $1.9 trillion coronavirus relief plan that includes those checks for most Americans.
Late last week, Biden urged Congress to take immediate action. On Monday night, the president hosted 10 GOP senators at the White House to discuss their views on relief which would include a smaller direct payment amount targeted to Americans most in need.
Republican were largely upbeat following the two-hour meeting.
It was a very good exchange of views. I wouldnt say we came together on a package tonight. No one expected that in a two-hour meeting but what we did agree to do is follow up and talk further, said Sen. Susan Collins.
The GOP proposal is a much slimmer $618 billion plan with $1,000 in direct payments to individuals earning up to $40,000 a year, or $80,000 for couples, according to a draft obtained by The Associated Press.
Meanwhile, Democrats who lead the Senate and House plan to take first steps this week toward delivering fresh assistance to Americans and businesses.
Thus far, the process has moved slowly as Biden mulled whether to appease Republicans by sacrificing some of his agenda or try to pass as much as possible on a party-line basis through the budget reconciliation process.

You Havent Filed Your 2019 Or 2020 Tax Returns

Many people probably havent filed their 2020 tax returns yet, given that the deadline for getting in your tax forms is April 15. In that case, theres no reason to worry the IRS will use your 2019 tax return to determine how much you should receive.
But this becomes trickier for people who arent required to file tax returns, such as those with no or very little earnings, which can be the case for some people on Social Security.
That became an issue with the first round of stimulus checks, especially since many of these people were in deepest need of the first rounds $1,200 payments and it wasnt an insignificant number. The IRS said it distributed more than 22 million stimulus payments last year that werent based on filed tax returns.
Because of that issue, the IRS last year created a website specifically for non-filers, where they could provide their bank account information or addresses to the agency, as well as provide their number of dependents, who were each eligible for $500 in stimulus aid at the time.
But the non-filers website has been closed since late last year, and IRS and Treasury officials said on a March 12 conference call with reporters that they are urging non-filers to file a 2020 tax return to ensure they get all the payments and tax credits they are owed.

When To Expect Your Third Stimulus Check
The US treasury and the IRS already started making the transactions starting on March 12. However, even if you can see the money as pending in your account, that money will not be accessible until March 17 which is the official release date.
With that in mind, the IRS set a deadline for later in the year to finish sending all the checks which means that there is still the possibility that the money will arrive much later into your account. Considering the number of people living in the United States, this is understandable.
What If I Don’t Receive My Check On The Expected Date
If your check doesn’t arrive on the date listed above based on your birth date or other circumstances, the Social Security Administration says to wait three additional mailing days before calling. If you still haven’t received it, you can then call 800-772-1213 to speak with a representative.
The SSA notes that wait times to speak with a representative are shorter Wednesday through Friday and later in the day .
While you wait, you can also access your Social Security benefits online by visiting ssa.gov/myaccount.

Which Of My Dependents Qualify For The Third Stimulus Check
For the third stimulus check, all your dependents qualify, regardless of age. This means that for each child or adult dependent you have, you can claim an additional $1,400.
This is different from the first and second stimulus checks, which only allowed child dependents to get the additional payment.
What Do Federal Benefit Recipients Who Dont File Taxes Need To Get Payment
No further action will be needed to receive a direct payment for most beneficiaries of Social Security retirement and disability, railroad retirees and those who received veterans benefits last year. Like the first two rounds of stimulus checks, the new payments will be sent out the same way benefits are normally paid.
But there are instances where some people receiving the automatic third payment based on their federal benefits information will need to file a 2020 tax return, regardless of whether they normally dont file one.
For instance, if your payment doesnt include a check for your qualified dependent, and that person didnt get one, the federal benefits recipient would need to file a 2020 tax return to be considered for the additional payment.
Also, those who are eligible but didnt get the first or second stimulus check or got less than the full amount may need to file a 2020 tax return to be eligible for the 2020 Recovery Rebate Credit. More information on that can be found here.

When You Could Receive The Third Stimulus Check
There are no firm dates, but President Biden recently announced that the first checks could arrive in March. And the IRS has said it’s going to try to get this round of stimulus payments out quickly.
“We are keeping our eyes closely on the hill,” Ken Corbin, chief taxpayer experience officer at the IRS, told CBS News.
That may not offer a specific time range, but we still have a good idea of how long it could take.
With the earlier bills, the IRS sent the first stimulus payments as soon as a couple of weeks after the bills were signed. It’s likely we will see a similar timeline or an even shorter one if and when this bill becomes law.
That said, there could be holdups that slow down the process this time around. The IRS will likely issue these checks during tax-filing season, unlike the last two stimulus payments. The agency’s handling both things at once could slow the rollout.
Payments also don’t go out all at once. With the first two stimulus payments, the money rolled out first to recipients who had their bank account information on file with the IRS. Those who did not have current bank info on file had to wait much longer for their payments.

Who Qualifies For The Third Stimulus Check
Millions of Americans who were eligible for the $600 second stimulus checks could qualify for the third round of stimulus payments up to $1,400. However, many high-earning taxpayers who were eligible for previous stimulus checks are now excluded. The plan narrows income eligibility to exclude individuals earning over $80,000 and couples making over $160,000:
- Singles phase out at AGIs between $75,000 and $80,000.
- Heads of household phase out at AGIs between $112,500 and 120,000.
- Couples phase out at AGIs between $150,000 and $160,000.
Keep in mind that this is different from the sliding scale that was used to determine eligibility for previous stimulus payments. The IRS reduced second stimulus checks by 5% for the total amount made over the AGI limit. This means that payments went down by $5 for every $100 over the limit.
The table below breaks down third stimulus payments based on narrower income ranges for singles and joint tax filers:
$1,400 Stimulus Checks With Narrower Income Ranges |
Single AGI |
$174,000 and up | $0 |

When Will Stimulus Payments Be Sent

Your stimulus payment may already be on its wayor you may have already received it. On March 12, the IRS announced that the $1,400 stimulus check will reach Americans within the week.
The first payments were sent by direct deposit and were scheduled to arrive on March 17. The IRS will continue to send additional batches of direct deposits, as well as mailing checks and debit cards, over the next several weeks.

Who Will Qualify For An Inflation
The payments are similar to the stimulus checks sent by the federal government in that they are based on income, tax-filing status and household size.
Lower- and middle-income Californians stand to receive the biggest checks.
- Single taxpayers who earn less than $75,000 a year and couples who file jointly and make less than $150,000 a year will receive $350 per taxpayer.
- Taxpayers with dependents will receive an extra $350, regardless of the total number of dependents.
In other words, a couple that earns a combined $125,000 and has two children would qualify for $350 per adult plus $350 for their children, for a total of $1,050.
When Is The Next Stimulus Check Released
- 10:13 ET, Dec 3 2021
MILLIONS of Americans have gotten some stimulus payments in the past year and some will get even more.
The direct payments intend to help citizens in need stimulate the economy by giving them more money to spend during a financial downturn.
As a result of the coronavirus pandemic, we have seen multiple stimulus check packages passed across the US.
Other forms of payments are going out ahead of Christmas as well.
But we explain below when the next set of stimulus checks could or have been confirmed to arrive.

When Will Third Stimulus Check Arrive
If we know anything about stimulus money by now, we’ve come to learn that it all doesn’t arrive at the same time. That could be true this time around, too, but there aren’t any details yet.
Tax professionals and others continue to wait for clarity from the Internal Revenue Service about the specifics involved with the rollout.
If the IRS sends you that money via direct deposit, you’ll likely be among the first to receive it, possibly as soon as this weekend, the White House says.
As part of the direct deposit process, the U.S. Treasury would start to send electronic messages to banks on Friday but bank accounts would not see any extra cash available immediately.
It’s expected that March 17 would be the effective date when the Treasury actually transfers the money, according to industry experts. More than 100 million payments are expected to be payable on March 17 via direct deposit.
Consumers should watch their bank accounts in the days ahead.
More than 233 million stimulus payments were issued via direct deposit during the past two rounds of Economic Impact Payments.
The first and second round of payments also involved 64.2 million stimulus checks and 11.6 million prepaid cards.
Paper checks and prepaid Visa debit cards — which are expected to be part of the third stimulus program — would be sent in the regular mail and take a bit longer, through April at least, according to estimates by Garrett Watson, senior policy analyst for the Tax Foundation.

Hold on to that IRS letter that confirms your stimulus payment, including giving the amount and how the IRS sent your money. That letter from the IRS — Notice 1444-C — is your proof that the IRS sent a payment in case you don’t actually receive it or if you received less than you qualify for and need to claim the missing amount later. Why $1400 Checks And Not $2000
Bidens plan called for $1,400 checks for most Americans, which on top of the $600 provided in the most recent COVID-19 bill would bring the total to the $2,000 that Biden has called for.
But Biden initially did not make that differentiation. Biden said on January 4 while campaigning for Democrats Jon Ossoff and Raphael Warnock ahead of Georgias Senate runoff elections, Their election will put an end to the block in Washington of that $2,000 stimulus check. That money that will go out the door immediately.

I’m A Nonfiler Do I Have To File Taxes This Year To Receive My Stimulus Money
A nonfiler is a person who isn’t required to pay taxes to the IRS during tax season. The requirement to file a tax return depends on your gross income, which is all income you receive in the form of money, goods, property and services that aren’t tax-exempt .
People who are considered nonfilers don’t need to do anything to receive a third stimulus check, according to the IRS. However, if you’re claiming missing stimulus money in a Recovery Rebate Credit, even nonfilers will have to file a tax return this year. You may be able to use a special form and file for free. You will, however, need some specific information.
If you’re age 65 or older, you should file taxes under the following circumstances:
- Single filer with at least $13,850 in gross income.
- Head of household with at least $20,000 in gross income.
- Qualifying widow age 65 or older with at least $25,700 in gross income.
In the 2019 tax year, the IRS introduced Form 1040-SR, US Tax Return for Seniors. This form is basically the same as Form 1040, but has larger text and some helpful information for older taxpayers.
More $1400 Payments Go Out Automatically After Aarp Urges Irs Ssa To Prioritize Federal Beneficiaries

by John Waggoner, AARP, Updated May 6, 2021
En español | The IRS has sent a wave of pandemic stimulus checks to government retirees who normally dont file federal income taxes. Now the agency is sending payments to Veterans Affairs beneficiaries who dont normally file taxes. But the Social Security Administration says if you are a beneficiary and havent gotten your stimulus check, you need to file a 2020 tax return now to get any stimulus payments due to you.
To date, the IRS has delivered 164 million stimulus payments worth about $386 billion during the coronavirus relief mandated by the American Rescue Plan Act, which President Joe Biden signed on March 11.
Many low-income beneficiaries including recipients of Social Security retirement and disability benefits, as well as recipients of SSI benefits administered by the Social Security Administration arent required to file tax returns, and some of those payments were delayed. The IRS said it was waiting for updated information from the SSA on bank accounts and addresses of federal beneficiaries to ensure the stimulus payments reach eligible individuals.
AARP has pushed the IRS and the SSA to move more swiftly to get those checks to individuals who dont file federal income taxes.
On March 25 the SSA gave the IRS the updated information required to begin delivering stimulus checks to some 30 million federal beneficiaries still awaiting payments, Saul said.
