Prison Inmates Cant Claim Social Security Or Unemployment Benefits

According to the Social Security Administration, Social Security Disability Insurance and Supplemental Security Income payments generally arent payable for the months that youre incarcerated for committing a crime.

If you receive Social Security at the time of your conviction, your benefits will be suspended if youre in jail or prison for more than 30 continuous days. You can get your benefits reinstated starting with the month following the month of your release. However, if you are incarcerated for longer than 12 months, your eligibility for SSI benefits will be terminated and you will have to file a new application after your release.

The Social Security office cant start your benefits until your release. They must have your official release documents from the jail or prison where you were confined.

I should note that even though inmates cant receive monthly Social Security benefits while incarcerated, benefits to spouses or children will continue as long as they remain eligible.

An individual released from incarceration may be eligible for Social Security retirement, survivors, or disability benefits if they have worked or paid into Social Security enough years. They could also be eligible for Supplemental Security Income benefits if they are 65 or older, are blind, or have a disability and have little or no income and resources.

Its impossible to say why the IRS took this unusual approach, but heres one theory: someone in the Treasury Department may have decided that giving money to incarcerated people is bad policy. But, by placing an FAQ on the agencys website saying that incarcerated people cannot receive the payments, some prison systems will probably do the IRSs dirty work by using the FAQ as a justification to intercept payments or bring disciplinary action against people who take the steps to claim the money to which they are legally entitled. In fact, weve heard that at least one state prison system is already doing this.

Calculating the recovery rebate credit is the same as the calculation of stimulus checks. It starts with a base amount, and for most people that is $1,800. That number comes from combining the two checks $1,200 plus $600.

A spokesperson for the Bureau of Prisons refused to confirm or deny that any inmates at federal facilities have received stimulus payment debit cards from the IRS.

Yaman Salahi, a partner at the San Francisco-based law firm Lieff Cabraser Heimann & Bernstein, said his office gets hundreds of calls and emails every week from incarcerated people around the country and their families who are trying to secure federal stimulus payments.

The government could still appeal the courts ruling again , but the permanent injunction should be cause for celebration for the over two million incarcerated individuals in the U.S. who may now be eligible for an economic impact payment.
