Social Security Number Rules For The First And Second Stimulus Checks
The eligibility rules differ for the third stimulus check and the first and second stimulus checks.
If you are not married and filing taxes as head of household, you must have an SSN to get the first and second stimulus checks.
If you are married filing jointly, only the spouse with the SSN will receive the first and second stimulus check. The exception to this rule is if one of you is in the military, then you are both eligible for both stimulus checks, even if one of you has an ITIN and one of you has an SSN.
Previously, for the first stimulus check, both spouses needed to have SSNs. If you were denied your first stimulus payment because both you and your spouse did not have SSNs, you can claim both the first and second stimulus checks as the Recovery Rebate Tax Credit on your 2020 tax return. See the chart and examples below for further explanation of how this works.
Your childrens status does not affect your eligibility if you meet the other requirements. However, you will only get the additional payment for dependents $500 or $600 for children who have an SSN or Adoption Taxpayer Identification Number , not an ITIN. A child must be related to you , under the age of 17, live with you for over half the year, have a Social Security number, and be claimed as your dependent.
Example:
John and Mary are married and filed their taxes jointly. Mary has an SSN and John does not. . Since the SSN rule change is retroactive, when she and John file their 2020 tax return.
Advance Designation: Choose A Representative Payee For Social Security To Consider Before You May Need One

The future can be uncertain. However, Social Securitys Advance Designation program can help put your clients in control of their benefits if a time comes when they need a representative payee to help manage their money. Advance Designation enables them to identify up to three people, in priority order, whom they would like to serve as their potential representative payee.
The following people may choose an Advance Designation:
- Adults applying for benefits who do not have a representative payee.
- Adults receiving Social Security benefits or Supplemental Security Income payments who do not have a representative payee.
- Emancipated minors applying for benefits who do not have a representative payee.
- Emancipated minors receiving Social Security benefits or SSI payments who do not have a representative payee.
If your clients fall into one of the above categories, they may provide and update Advance Designation information when they:
- File a claim for benefits online.
- Use the application available in your personal mySocial Security account.
Your clients may also change their Advance Designation, including the priority order, at any time while they are still capable of making their own decisions. In the event that they can no longer make their own decisions, your clients and their family will have peace of mind knowing they already chose someone they trust to manage their benefits.

Here Are Some Questions And Answers Around This New Stimulus Payment:
If I didnt file taxes in 2019/2020 will I receive the stimulus ? Unlike the first stimulus payment where those who didnt need to file a tax return could update the IRS non-filer tool, this time around due to the speed of roll-out of the second stimulus check and with tax season around the corner the IRS has said the non-filer tool is closed for updates. The IRS will be using information they have as of Nov 21, 2020 or from your first stimulus check payment . Otherwise they are encouraging you to the stimulus by filing a 2020 1040 or 1040-SR tax return. Free tax software programs can be used by people who are not normally required to file tax returns but are eligible to claim the credit.
How will I get paid? Like the first stimulus payment in 2020, the IRS will facilitate payment of these checks based on your 2019 tax information. You will also get the dependent stimulus payment for eligible dependents claimed on your tax return. For other groups who dont file taxes the IRS will work with other government departments or the Get My Payment tool. Direct deposit will still be the fastest way to get your payment.
Dependents in 2020? Households who added dependents in 2020 might not qualify for full payments immediately, since based on 2019 tax return information. But they can request additional money as part of the 2020 tax returns they will file in early 2021. See more in this articles for dependent qualification income thresholds.
Information Regarding Economic Impact Payments For Social Security And Ssi Beneficiaries With Representative Payees And People Living In Us Territories
The Social Security Administration issued an update today about COVID-19 Economic Impact Payments to certain groups of Social Security and Supplemental Security Income beneficiaries. Beneficiaries who have their regular monthly payments managed for them by another person, called a representative payee, will begin receiving their EIPs from the IRS in late May.
Special rules apply to beneficiaries living in the U.S. territories: American Samoa, Guam, Puerto Rico, the Northern Mariana Islands, and the U.S. Virgin Islands. In general, the tax authority in each territory, not the IRS, will pay the EIP to eligible residents based on information the IRS will provide to the territories. It is anticipated that beneficiaries in the territories could begin receiving their EIP in early June.
The Social Security Administration has been working with the IRS to provide the necessary information about Social Security and SSI beneficiaries in order to automate and expedite their Economic Impact Payments, said Andrew Saul, Commissioner of Social Security. While millions of our beneficiaries have already received their EIPs from the IRS, we continue to work hard for those beneficiaries who are awaiting their payment from the IRS.

A Push For More Stimulus

To help those on Social Security get through, TSCL is not only calling on Washington for help, but theyre asking the public to add their names to a public petition. The petition reads:
I want Social Security recipients to receive a $1,400 emergency stimulus check to cope during this unprecedented inflationary year. Social Security benefits are one of the few types of income in retirement adjusted for inflation. But soaring inflation has taken a toll on household finances of retired and disabled Social Security recipients. In 2021, Social Security benefits increased by just 1.3%, raising the average benefit by only about $20 a month. But about 86% of Social Security recipients surveyed say their expenses increased by much more than that amount.
As one of the many supporters of TSCL who reside in your constituency, I strongly urge you that now is the time that you must support an emergency $1,400 stimulus check to Social Security recipients.
Given the fight currently raging over President Joe Bidens Build Back Better plan and whats going to happen to the debt ceiling, no one expects Congress to approve a fourth round of stimulus checks for senior citizens this year. Still, the hope is that as public sentiment grows, Congress will take notice and address the issue next year.

Social Security Safeguards Our Most Vulnerable Citizens
Disability benefits offer a financial lifeline when people are struck by a serious medical condition that affects their ability to perform substantial gainful activity in the workforce on a sustained basis. Benefits are for medical conditions that are expected to last at least one year or to result in death. The Social Security and Supplemental Security Income disability programs are the largest of several federal programs that provide assistance to people with disabilities. Our friends, family members, and neighbors, including wounded warriors and the chronically ill, rely on these vital programs:
- Social Security Disability Insurance pays benefits to you and certain members of your family if you are “insured,” meaning that you worked long enough and paid Social Security taxes.
- Supplemental Security Income pays benefits based on financial need.
Your clients can learn more about Social Security disability benefits at: www.socialsecurity.gov/disability and SSI at www.socialsecurity.gov/ssi.

Payment at the Protected Payment Level
Yes, effective October 29, 2021, if you request reconsideration of a change in payment for non-medical reasons within 60 days of receiving a letter about the change in payment, you will continue to receive payment at the previous payment level until a new determination is made, unless you ask not to receive continued payment. Therefore, if you file a reconsideration request within 10 days of receipt of a letter, there will be no change in your payment. If you file a reconsideration request more than 10 days after receipt of a letter, your payment may change temporarily, but we will restart the previous payment amount once we receive and enter your reconsideration request, and you will receive that amount until we decide your reconsideration request. Remember, SSA presumes that you receive a letter five days after the date on the letter unless you provide evidence that it took longer than five days. You can file an appeal by taking one of the following actions.
Online at SSA.gov
The quickest and easiest way to file an appeal is online at our Appeal a Decision page. Select Reconsideration and then the Request Non-Medical Reconsideration button. Follow the instructions on the screens to complete and submit the appeal electronically.
