There is a catch on children, however: only kids who haven’t yet turned 17 are eligible.

Stimulus Checks: Children And Dependents

Q. I had a baby in late 2020. Am I eligible for the child stimulus payments?A. If you had a baby in 2020, you are eligible for the $1,400 credit in 2021. This will be paid in an advance third stimulus payment if you filed your 2020 return by the time the payments were issued. If you didnt receive the first or second stimulus payment for your baby, you can claim the recovery rebate credit when you claim the child on your 2020 return.

Q. I have joint custody of my daughter with my ex-spouse, and I claimed her on my 2019 taxes . What do we need to know when my husband claims her?A. For the first and second payments, the spouse claiming the child in 2020 will claim the children and could receive the recovery rebate credit on the 2020 return.

However, for the third payment, divorced parents who alternate claiming their dependents each year, if an advance payment is received by one spouse for the dependent, no additional payment can be made for the same dependent on the other spouses return.

For example, if the payment is issued to Parent 1 because they claimed the child on their 2020 return, Parent 2 cannot claim the credit on their 2021 return even though they didnt receive the payment from Parent 1.

The second way is claiming the Recovery Rebate credit on your 2020 taxes, which you can do for the first or second payments. Youll receive the correct amount in the form of a tax credit that either lowers your tax bill or gets added to your refund.

How Is The Third Stimulus Check Calculated

The stimulus plan mandates the treasury to rely on 2019 and 2020 tax returns to calculate how much you could get for the third round of stimulus checks.

Congress approved limits based on adjusted gross income ranges. This means that taxpayers making less than the minimum threshold could get the full stimulus check, while those earning above it get reduced payments until they are fully phased out at higher incomes.

You can find your AGI on IRS form 1040. This is calculated by subtracting deductions like student loan interest, health savings account payments, and contributions to a traditional IRA from your gross income.

By contrast, your gross income is the total amount of money that you made during the tax year, including wages, dividends, capital gains, rental property income and other types of revenue.

Your 2019 taxes had to be filed by July 15, 2020. And your 2020 taxes are due by the extended deadline of May 17. You can read more about when to file your tax returns for the third stimulus check, and other IRS requirements in two tax sections below.

How The Third Stimulus Check Became Law

The American Rescue Plan was signed into law on March 11, authorizing a third round of stimulus checks that pay a maximum of $1,400 for millions of Americans. Targeted income limits, however, exclude individuals earning over $80,000 and joint tax filers making more than $160,000.

Biden said at the signing of the bill: this historic legislation is about rebuilding the backbone of this country and giving people in this nation working people and middle-class folks, the people who built the country a fighting chance. Thats what the essence of it is.

House Democrats had moved the $1.9 trillion COVID-19 relief bill to Bidens desk with a 220-211 vote just one day earlier. But progressives in the party expressed concern over Senate amendments that excluded higher-earning taxpayers from getting a stimulus payment.

Biden agreed to narrow income level requirements as a concession to moderate Senate Democrats who wanted to cap payments for individual taxpayers at $80,000 and joint tax filers at $160,000.

The Senate bill narrowly passed with a 50-49 vote on March 6 after an overnight marathon of disputed amendments and negotiations. A 50-50 tie between both parties was avoided because Senator Dan Sullivan could not vote after returning to Alaska for a family funeral.

Did The Irs Use Your 2019 Taxes Or 2020

If you got a lot less money than you think you should have, the most likely culprit is that the IRS used your 2019 tax information to calculate your third stimulus check rather than your 2020 tax return — which is officially due May 17. You can use an IRS tracker tool to see if the agency received and processed your 2020 return .

If the IRS owes you additional money, you’ll be due a plus-up payment, which can take into account any change in your AGI and new dependents, including a new baby. We strongly suggest using our stimulus check calculator to ballpark how much you should expect, because the IRS won’t tell you in its stimulus payment tracker.

  • Adults whose adjusted gross income is less than $75,000/year will get $1,400 for each adult, plus $1,400 for each dependent no matter how old they are. This applies to heads of households who make less than $112,500, as well.
  • The IRS will use income information from your 2020 tax return if they received that return before sending your money. Otherwise they will use information from your 2019 tax return.
  • If the IRS sends your payment based on a 2019 return and then your 2020 return says you qualify for more , they will send an additional payment to make up for the difference. To get the additional payment, you must file the 2020 tax return by 90 days from the filing deadline or September 1, 2021, whichever is earlier.

Criticism Of Stimulus Checks And Programs

Critics contend that the stimulus added some $1 trillion to the deficit and simply shifted economic activity that would have happened anyway. A Mercatus study pointed to unemployment rates, which rose even after the stimulus was implemented, as proof that stimulus checks were ineffective during the 2008 recession.

According to the study, the median duration of unemployment reached a high of 25.5 weeks in June 2010, after averaging 7.2 weeks from 1967 to 2008. Others, like American economist Paul Krugman, have contended that the stimulus amount was too small to be effective.

Which Tax Year Will Be Used To Determine Eligibility

The IRS will use either your 2019 tax return or your 2020 tax return .

If your income has decreased during the pandemic, you could benefit from filing your 2020 taxes earlier, especially if you now qualify within the new AGI limits. But if you made more money and your income puts you above the requirements, you may want to delay filing and use your lower 2019 tax return.

Note that if you earned over the third check stimulus income limit for your 2020 tax year, and you use your 2019 tax year to claim the stimulus payment, the IRS will not mandate you to pay it back.

You should also keep in mind that the IRS will not treat your stimulus check as an advance or a federal government loan either. This means that it wont be deducted from your tax refund and you dont have to pay it back. And the agency wont tax your payment, so you will not have to report it as part of your yearly taxable income.

If you do not usually have to file a tax return, the IRS has created an online tool that allows you to enter your personal and bank account information to get your stimulus payment.

Your AGI is relatively easy to find it’s listed on your annual tax return. Specifically, it’s on line 8b of your 2019 tax return.

Your stimulus check eligibility will be determined by the AGI on your latest tax return. If you’ve not yet filed your 2020 taxes, the AGI from your 2019 tax form will determine eligibility. If you’ve filed your 2020 taxes and they’ve been processed, that number will be used.

Whats Different About This Third Stimulus Payment Compared To The Previous Two

Payments to those earning more than the defined threshold amounts are phased out at a more aggressive rate, resulting in a lower eligibility cutoff. As a result, many Americans who qualified for the first and second stimulus checks wont be eligible for this round.

However, payments for qualifying dependents in the third stimulus will match the payment amounts sent to qualifying taxpayers themselves. For many people, this will mean a larger supplemental payment than in previous stimulus distributions. And, unlike the first and second stimulus programs, the third stimulus doesnt exclude dependents over 18 years of age. This means that millions of college students, elderly and disabled dependents of eligible tax filers will qualify for the supplemental payments.
