The eligibility requirements for the third stimulus check has been a contentious issue in recent weeks and President Biden was forced to make amendments to his original American Rescue Plan to ensure the bill passed Congress.

Opposition in the Senate saw the upper income threshold lowered considerably, meaning that up to 12 million Americanswill now miss out on receiving any of the money.

We ran through the eligibility requirements to work out who gets the third stimulus check, and how much of the $1,400 they could be entitled to.

Nonfilers May Need To File A Tax Return To Register Dependents

Though many people automatically received stimulus payments for their dependents, some will need to file a 2020 tax return, per the IRS. This is because the IRS may not have all your dependents on file if you don’t usually file a tax return — for example, if you gained a new dependent in 2020 or if you had a baby. This also applies if you gained a dependent over the age of 16 or an older adult dependent.

You can use the IRS’ Free File tool if you make less than $72,000 a year. Once you’re on the site, select Choose an IRS Free File Offer to see a list of tax software companies you can use. The software should walk you through how to file your return and the Recovery Rebate Credit Form 1040 or Form 1040-SR for free. The IRS said it’s sending “plus-up” payments to individuals and families who are eligible for a larger payment based on their 2020 tax returns, including if they have new dependents.

How Can Dependents Qualify For Their Stimulus Check

Who Are Adult Dependents

Adult dependents are people 17 and older who are claimed as dependents on someone elses tax return. This includes high school or college students, adults who live at home and are dependent for another reason, or elderly adults that live with others and are counted as dependents at tax time.

This group could total 27.4 million, according to Kyle Pomerleau, a fellow at the American Enterprise Institute.

In the last two rounds of checks, dependents were defined as children who are eligible for the child tax credit. This only included children under the age of 17. Under that definition of dependents, there were 70.1 dependents eligible, Pomerleau wrote in an email.

With the addition of adult dependents, the total number of eligible dependents rises to 97.4 million.

Heres Why Dependents Arent Always The Same For Taxes And Stimulus Checks

In terms of federal tax regulations, a dependent can fall into two categories: a qualifying child or a qualifying relative. They dont need to be children, or directly related to you, but they do have to meet certain requirements set out by the IRS.

To be claimed as a dependent on your taxes, a qualifying child must be either younger than 19 years old, or a student younger than 24 years old at the end of the calendar year. If, however, your child is what the IRS calls permanently and totally disabled, you can claim them as a dependent no matter their age.

To claim a qualifying relative either a child or an adult as a dependent, they must meet other IRS criteria. This might include an elderly relative who relies on you for care.

Even if a dependent was claimed on your tax return, only people who meet a specific definition of child dependent were eligible to count toward the households money from the first round of stimulus checks due to the requirements of the CARES Act. The same was true for the second round under the December $900 billion law: The child dependent must be age 16 or under as of your 2019 tax return to qualify for any payment.

However, as mentioned, the current proposal under consideration for a third check would make dependents of all ages, including young adults and older adults, eligible to add up to $1,400 each to the households total.

One of the key inclusions in the new stimulus bill is a complete overhaul of the child tax credits provision which would see claimants able to receive up to $3,600 per year. As it stands the change would only last for the duration of one tax year but President Biden has reportedly stated that he is in favour of making the change permanent.

The increase is considerably higher than the $2,000 currently on offer and would be open to more of the lowest earning households the credit was made fully refundable. The payment method is also tweaked to make it more like the stimulus checks, with a monthly direct debit of up to $300 going out to eligible Americans.

What Steps Do I Need To Take To Receive An Economic Impact Payment

If you receive certain social security, retirement, disability, survivors, railroad retirement, or veterans benefits, you may automatically qualify to receive a payment. Learn more to see if this applies to you.

For most people, you will not need to take any action and the IRS will automatically send you your payment. For some people who are eligible for a payment, the IRS will need more information from you first before they can send you money. You will do this using one of two different IRS portals. It is important that you provide this information using the right IRS portal so that the IRS can process your information quickly.

  • If you already filed your 2018 or 2019 taxes, go to the IRS Get My Payment portal to check the status of your payment. This portal will let you know if your payment has been processed and let you know if the IRS needs more information before sending you your payment.
  • If your payment has already been processed, the IRS does not need any more information from you at this time.
  • If you paid additional taxes when you filed your tax return, it is possible that the IRS does not have your payment account information to direct deposit your payment. You can provide that directly in the portal so that they can process this information quickly and send you your payment. If the IRS does not have your direct deposit information and you dont provide it to them, your payment will be sent to you by check to the address they have on file.

People Who The Irs Doesn’t Know About

The IRS will automatically send a third stimulus payment to people who filed a 2019 or 2020 federal income tax return. People who receive Social Security, Supplemental Security Income, Railroad Retirement benefits, or veterans benefits will receive a third payment automatically, too. However, if the IRS can’t get the information it needs from your tax records, or from the Social Security Administration, Railroad Retirement Board, or Veterans Administration, then it can’t send you a check.

However, if you don’t get a third stimulus check now, you won’t lose out on the money if you’re eligible for a payment but you’ll have to wait until next year to get it. You’ll be able to claim the proper amount as a Recovery Rebate tax credit when you file your 2021 tax return, which is due by April 18, 2022 .

Dependent Eligibility For Stimulus Checks Keeps Changing

The American Rescue Plan for single filers to receive $1,400 and joint filers to receive $2,800, if they meet certain income requirements. They also get “$1,400 multiplied by the number of dependents of the taxpayer.”

This was a departure from previous stimulus checks.

The first round of payments, passed as part of the March 2020 CARES Act, provided taxpayers with $1,200 plus $500 per qualifying child. That category included any “child, stepchild, eligible foster child, sibling, half sibling, step sibling” or descendant claimed as a dependent. But there was an age limit. They had to be “younger than 17 at the end of the 2019 tax year.”

The second round of payments, approved in late December, provided $600 for single filers plus $600 per qualifying child. Again, dependents over 17 didn’t qualify.

The rules boxed out millions from aid. Parents can generally claim kids who live with them half of the year, students between 19 and 24, children with disabilities, and certain relatives for whom they provide financial support. But these dependents didn’t qualify for the stimulus checks, leading to outcry among families. Some high school seniors didn’t even make the cut.

The American Rescue Plan, though, nixed the age restriction. Kids and students as well as adult dependents like parents and grandparents were all included.

Imagine a family of three. Mom and Dad qualify for the full payment, as does their 20-year-old dependent daughter in college.

Can Creditors Take My Check

Can back taxes or child support be taken out of the checks? The stimulus payments are not taxable and are not subject to garnishment by the government for back taxes or student loan defaults. The same is true for past due child support payments or private debts–for the second and third stimulus checks.

Can my bank take my stimulus check? If your bank account is overdrawn because of overdrafts or outstanding fees, your bank may take part or all of your stimulus check to bring your account even. However, when the second stimulus check came out, many large banks stated that they would bring customers’ bank balances to zero, temporarily, so that customers could access their stimulus checks. This includes Bank of America, Wells Fargo, Citigroup, and JPMorgan Chase.
