Judges Wage In On Stimulus Rights For Incarcerated Citizens
Then in late September, Forbes reported that US District Court Judge Phyllis Hamilton issued an order which included a requirement to the IRS and Treasury Department to stop withholding stimulus checks to prisoners and inmates solely on thebasis of their incarceration status.
There is nothing in the CARES Act that gives the IRS authority to decide that incarcerated people are ineligible to receive stimulus checks, said Senator Sherrod Brown , talking to Forbes Inmates who are disproportionately people of colour and from low income communities already suffer from a lack of resources and heightened exposure to Covid-19 due to the failed response to the virus by the prison system. Incarcerated people and their families need more help during this pandemic, not more undue punishment, the Senator said.
Its estimated that the judges orders could bring relief to over 80,000 incarcerated individuals who collectively should receive upwards of $100 million in stimulus checks. The population eligible for payment may be even higher as the lawsuit alleged that over 1.4 million individuals have been affected by the IRS denial of payment to prisoners and inmates.

No. The Economic Impact Payment is not considered to be taxable income. “And you shouldn’t report it as income on your 2021 federal income tax return,” according to Letter 6475.
You also do not need to repay any of the third stimulus payment money that you received. That’s true even if you’d qualify for a smaller payment based on what you’d calculate for your 2021 Recovery Rebate Credit.

Can Another Person Request A Stimulus Payment For The Incarcerated Individual
Most jails and prisons do not allow internet access, or allow limited access to email, for example, to those incarcerated in them, so it seems improbable if not impossible that individuals themselves could follow the IRS instructions for providing information online. The instructions on the IRS website dont explicitly say that a representative friend or family member can notify the IRS regarding an incarcerated person, so the answer isnt clear. There is also the option to fill out paperwork by the Nov. 4 deadline.

What Should I Do Now
There are several things you can do now ahead of a third stimulus payment to ensure things go as smoothly as possible.
- Make sure the IRS has direct deposit information for you so you will be among the first to receive a stimulus payment.
- If you havent filed your 2020 taxes, consider any difference between 2019 and 2020 income. If the IRS uses your 2019 taxes and you receive more than you would have using 2020 taxes, then you likely wont have to pay that money back.
- Conversely, if you receive a stimulus based on 2019 and actually qualify for more in 2020, then you can claim the difference as a Recovery Rebate Credit when you file your 2021 taxes in 2022.
- If you have a refund coming in 2020 or have makeup prior stimulus credits coming, then you may want to file now to get that money.
- To avoid not receiving your third stimulus and having to claim it as a credit in 2022, even if you dont normally have to file income taxes, consider doing it this year to make sure you are in the IRS system.

Who’s Eligible For The Payment
Those eligible for the money could include people whose tax situation changed in 2021, but the change was not reflected in their latest tax return.
For example, parents who welcomed a child in 2021 may be eligible for the $1,400 payments as long as they meet income requirements.
Eligibility for the third round of stimulus checks, issued earlier this year as part of President Joe Biden‘s American Rescue Plan, was based on a family’s last tax return filed.
Since babies born in 2021 were not factored in, the $1,400 checks will be applied to their parent or guardian’s 2021 tax return.
Others may be eligible for more money as well due to a change in income or the addition of a dependent.
Payments begin to phase out for people who make more than those income limits.
They completely phase out for individuals who make more than $80,000 and couples who make more than $160,000.
The number of families still owed a $1,400 stimulus check is not yet known but it is estimated to be in the millions.
The figure wont be known until the total number of births for 2021 is revealed.
Do You Have To Send A Check Back If The Irs Asks
According to tax experts who spoke to MarketWatch, the CARES Act did not include a clawback provision that would allow the IRS to force people who received stimulus checks in error to return those checks. So far, the IRS has not indicated there will be any kind of penalty for not sending back stimulus payments, although the agency does make its expectation clear and has a web page that details the process for returning stimulus payments. Either way, the question is moot so long as the current federal court order still stands.
Millions of nonincarcerated people, as well as many behind bars, who are still waiting for stimulus checks, may feel theyve been hung out to dry.
The IRS asks recipients to return checks for people who have recently died and people who received additional money in error, for example, if they received two payments instead of one, or are a citizen of another country that is not a US territory. For example, dozens of Austrian citizens reportedly received $1,200 bank transfers representing stimulus money, in error.

State And City Stimulus
Some states have also given out extra stimulus payments, including California and Maine, with many using funds from the Rescue Act.
In 2021, California launched two-state stimulus programs: the Golden State Stimulus I and Golden State Stimulus II.
These stimulus checks are worth up to $1,200 and $1,100, respectively.
Furthermore, the state recently issued about 139,000 stimulus checks.
Moreover, California plans to send out up to another 70,000 stimulus checks starting mid-March.
Those getting paper checks need to allow up to three weeks for them to arrive.
Eligible Maine residents received $285 stimulus payments until the end of 2021, and it’s unclear if this will continue into 2022.
Another city in California, Santa Ana, started sending out $300 payments loaded on prepaid Visa debit cards last year.
“So far about 2,700 have been distributed and we plan to give out up to the full 20,000 cards either in person or notifying qualified residents by mail to pick them up,” a Santa Ana official told The Sun in December.
According to a statement by the city, those with poverty rates above the Santa Ana median of 42% will qualify for the support.
Also, thousands of St Louis, Missouri residents were able to claim a $500 stimulus check in December.
However, applications for the moment are paused and the city will keep the public informed on any potential future reopening of its portal.
Meanwhile, the deadline to claim a $4,000 stimulus check in New Jersey has passed.
Is The Child Tax Credit Expanded
Yes, the American Rescue Plan includes a temporary increase for the child tax credit for 2021.
The credit is worth $2,000 per child under 17 that can be claimed as a dependent.
It temporarily boosts the credit to $3,000 per child, or $3,600 per child under 6. It allows 17-year-old children to qualify for the first time.
The credit will begin to phase out for those earning more than $75,000 a year, or $150,000 for those married filing jointly. The IRS will look to prior-year tax returns to determine who qualifies for the higher credit. If a return for 2020 hasnt been filed yet, the agency will look to 2019 returns.
Families who aren’t eligible for the higher child credit may still be able to claim $2,000 credit per child.

Recovery Rebate Tax Credit
So, how do you get the third stimulus check money you’re owed by filing your 2021 tax return? On Line 30 of your 2021 return , you’ll see the recovery rebate tax credit. This is where you stake your claim to the stimulus check funds you didn’t get last year.
Third stimulus checks were merely advance payments of the recovery rebate credit. As a result, your credit for the 2021 tax year will be reduced by the total amount of your third stimulus check . Most Americans received the full credit in advance, so their 2021 recovery rebate credit will be zero. But if you didn’t receive a third stimulus check or got less than what you should have , then you can claim the difference between the credit amount you’re allowed and what you actually received in advance as a tax credit on your 2021 return. The credit will reduce your tax bill, and for many people trigger a tax refund or boost the refund otherwise due.
There are a number of other scenarios that can trigger a recovery rebate credit on your 2021 return. So, if you didn’t receive the full third stimulus check amount last year, make sure you complete the worksheet to see if you qualify for a credit.
